“I don’t believe the Estate Agency Affairs Board looks after rental property agents, I don’t believe the Estate Agency Affairs Act gives rental agents the credence they deserve and that it is sales agent-centric. I don’t believe the rental agents are protected well enough by the Rental Housing Tribunal and I don’t believe that the Rental Housing Act protects Rental Agents to the degree necessary.”
An unfortunate truth for rental property agents in South Africa
Tenants are consumers in a lease agreement and landlords are consumers in a mandate. Both fall under the Consumer Protection Act which leans heavily in their favour, and to a lesser degree rental property agents.
The Estate Agency Affairs Act focuses on sales agents and the Rental Housing Act focuses on tenants and landlords, once again leaning heavily in favour of all the parties to a property transaction, and to a lesser degree rental property agents.
Rental property agents are the suppliers of services to landlords and tenants, and need education and guidance to be able to excel in an industry beset with a multitude of legislation and those fly-by-nights who seek to undermine the very system our rental property agents study and pay so much to be a part of.
