I am told that I am only allowed to hold two proxies for our upcoming AGM. And the managing agent also told me that I will only have one vote at the AGM despite the fact that I own three sections in the scheme. Please clarify. – Mona


Hi Mona, what you are referring to is contained in the Sectional Title Schemes Management Act (Act 8 of 2011).

In 2011 the STSM Act was first published to come into force on a date to be announced by the minister. The Act could not come into force before its regulations had been finalised.

Then, finally, on 2 October 2015, these regulations were published and opened for public comment for a period of 30 days. The department is currently reviewing all the comments it received and will announce the final regulations as well as the date that the Act will come into force thereafter.

So currently you can hold more than two proxies and you can have one vote per section as this Act is not yet in force.Trafalgar logo fc_pay off line

    Owners, including trustees are making use of one our staff during normal working hours to clean their units. They are paying cash which obviously is not being declared. They have admitted this and the caretaker and managing agents are aware but this still continues. What laws are they breaking.
