Q

Is it compulsory to be an estate agent to be the managing agent for a sectional title scheme? The scheme has its own bank account with the trustees as the signatories with no trust funds. The trustees are responsible for the maintenance together with an accountant who is responsible for the monthly levies and accounts to owners. Please can you refer me to the applicable sections of the act. – Hennie

A

Dear Hennie, all managing agents must be registered with the Estate Agency Affairs Board (EAAB) and have a valid Fidelity Certificate from the EAAB. They must also be registered debt collectors under the Debt Collectors Act.
