Sectional title corner – I want to sell but can’t get the financial statements

Q

Hi, I’m in a situation where we pay levies every month in a complex but we are getting no services (excluding buildings’ insurance and a security gate) which we are told is being paid for. And as for other services, they cannot be done due to other residents having stopped paying. Our managing agency is based in Cape Town while our complex is in the West Rand of Gauteng.

Since 2014 I have been asking for the scheme’s financial statements but cannot get them from the agency, while the one that was sent to me was half done in 2013. Currently, I want to sell but I can’t due to not being able to access the scheme’s financial statements. What can I do? – Lerato

A

Hi Lerato, when a complex registers with the Community Scheme Ombud Service (CSOS) it has to be given certain documents – including the financial statements. So if the managing agency is not giving you the correct documents, request a copy from the CSOS.
