Sectional title corner – Are owners ever responsible for fixing their own roof?

Hi Albert, it is generally the body corporate, but I have seen instances where the roof is an exclusive use area (EUA) and then it gets more complicated.
- If it’s an EUA in terms of the plans then it is the body corporate and they must charge an EUA levy to cover such costs.
- If it’s an EUA in terms of the rules and the rules say the owner is responsible for maintenance then it is the owner and the body corporate may not then charge an EUA levy.
- If the rules say nothing about maintenance then it is the body corporate and they must charge an EUA levy to cover such costs.
