Sectional title corner – Can the complex owner pass on the CSOS levy to tenants?
Hi, my mother rents an apartment in Kronendal Village in Hout Bay, Cape Town, owned by the Cape Peninsula Organisation for the Aged (CPOA). The village has started charging her the CSOS levy. My question is if my mom has to pay the levy, seeing as she does not own the unit? If the unit is still owned by the CPOA, do they have to cover the levy? – Rose
Hi Rose, if CPOA is the registered owner of the unit then the complex (body corporate or homeowners association) should charge CPOA the CSOS levy. It is up to the owner to then decide if they want to recover it from their tenants (as a levy or by increasing the rent).
