Sectional title corner – How many votes does a multi-owned unit have?
Hi, in a complex of townhouses where voting rights are unit based (not number of votes as determined by participation quotas), and if the unit is registered in the name of more than one person (say two or three), how many votes is that unit entitled to? – Joao
Hi Joao, all voting (except for special and unanimous resolutions) takes place “in value”: which means by participation quotas/nominated values.
For special and unanimous resolutions you have to take into consideration “in number” and “in value”.
When you work on “in number” the Act states that it is “one member, one vote”. So it does then not matter how many units you own – you are just one member and have just one vote.
In your case, when one unit has more than one owner, the owners together form one member and have just one vote. You can never have more than one vote per unit.
