Deed of sale: Witnesses need to give their full details now too
The role of a witness is to be able to attest to the authenticity of a signature. A witness does not need to be familiar with the content of the document which they are witnessing, but must be able to identify and confirm the authenticity of a party’s signature in the case of a dispute.
In ABSA’s recent “Minimum Supporting Documentation” communication, the bank requires that a witness on a deed of sale provide their full names and surname, their identity number and attach their full signature on the document.
All deeds of sale must contain the full details of the witnesses as of 1 May 2017. Estate agents must ensure that the full details of all witnesses and other relevant parties are included in the deed of sale before sending it on to the bond originator to prevent future delays in the purchaser’s application for bond finance.
