Sectional title corner – Does our scheme need a constitution?
Hi, We are four full title units in Vereeniging that only recently draw up some rules and regulations. Please assist us by providing answers to the following questions:
#1 Do we need a constitution, and how do we go about getting this done?
#2 We are not registered with CSOS, would you advice that we register?
#1: Yes, due to the fact that you are a voluntary organisation you will need a constitution. The attorney that set up your Home Owners Association will be able to assist you with this too.
#2: In accordance with the CSOS Act all community schemes must register with CSOS and the non-compliance with the Act can lead to jail time and fines for the scheme executives (directors/trustees). This registration form should be completed and sent to CSOS together with the relevant documents.
