[WATCH] When is an estate agent negligent?

I own a sectional title which is currently managed by a prominent real estate company in Richards Bay. They have managed my property for the past year and half as I was out of the country. To date my income from the property is under R15,000 (for the entire period), which used to bring me at least R5,000 a month previously.

A few tenants have come and gone, and not paid rent at all. I was promised many things with regards to the rent and rental recovery, but nothing emerged. The current tenant has also followed suit in defaulting. When I queried as to what is going on with the rent, I was told that I need to deal directly the tenant as they have no dealings with the rental albeit I have an agreement in place on their company letter head. Eventually they realised they were wrong and promised me rental would be paid. Nothing happened.

What recourse can I take, if any? Who’s liable for my losses over this period? – Vimaan
